Terms of Service

Estate Leads ("we," "our," or "the Service") is a research and data aggregation service operating from Kelowna, British Columbia, Canada. We provide licensed real estate professionals with pre-researched lead packages containing publicly available information about For Sale By Owner (FSBO) and Expired/Withdrawn property listings in the Okanagan region of British Columbia. Estate Leads is not a real estate brokerage, not a licensed real estate agent, and is not affiliated with the Canadian Real Estate Association (CREA), the BC Real Estate Association (BCREA), the Association of Interior REALTORS® (AIR), or any Multiple Listing Service® (MLS®) board. The terms REALTOR® and MLS® are trademarks of the Canadian Real Estate Association and are used here for descriptive purposes only.

The Service is intended exclusively for licensed real estate professionals in British Columbia, Canada, including but not limited to: • Licensed REALTORS® and real estate agents registered with the BC Financial Services Authority (BCFSA) • Licensed real estate brokers and managing brokers • Real estate team leaders and brokerage managers By purchasing or subscribing to any Estate Leads product, you represent and warrant that you are a licensed real estate professional in good standing with the BCFSA or the applicable provincial regulatory body. The Service is not intended for consumer use, and no information provided by Estate Leads should be used to contact property owners for any purpose other than legitimate real estate representation.

All leads provided by Estate Leads are sourced exclusively from publicly available platforms, including but not limited to: • Kijiji.ca • ForSaleByOwner.ca • PropertyGuys.com • Facebook Marketplace (public listings) • Castanet Classifieds • Publicly available BC market reports and property records Estate Leads does not access, purchase, or use any data from the MLS® system or any board-restricted database. We do not provide data obtained through unauthorized means. All contact information provided (where available) was publicly listed by the property owner on the above platforms at the time of research. We do not independently verify, guarantee the accuracy of, or warrant the completeness of any contact information provided.

Users of the Estate Leads service are solely responsible for ensuring their use of the data complies with all applicable Canadian laws, including but not limited to: CASL (Canada's Anti-Spam Legislation): You are responsible for ensuring that any electronic communications you send to leads comply with CASL requirements, including obtaining express or implied consent where required. PIPEDA (Personal Information Protection and Electronic Documents Act): You are responsible for handling any personal information contained in lead packages in accordance with PIPEDA and applicable provincial privacy legislation, including BC's Personal Information Protection Act (PIPA). Real Estate Services Act (BC): You are responsible for ensuring that your prospecting activities comply with the Real Estate Services Act and the rules and bylaws of the Association of Interior REALTORS® or your applicable board. Estate Leads provides data for research purposes. The manner in which you use that data is your sole responsibility.

Estate Leads makes no representation or warranty, express or implied, that the use of our lead packages will result in any specific number of listings, sales, commissions, or business outcomes. Real estate prospecting results depend on many factors beyond our control, including market conditions, individual agent skill, and seller circumstances. We do not guarantee that any lead will result in a listing appointment, a signed listing agreement, or a completed sale.

Single Package Purchases: If you believe a delivered package does not meet the quality standard described on our website, contact us within 48 hours of delivery at [email protected]. We will review the package and, at our sole discretion, issue a credit toward a future package. Monthly Subscriptions: You may cancel your monthly subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period. Exclusive Territory Plans: Exclusive Territory plans require 30 days written notice to cancel. No refunds are issued for the notice period.

All lead packages, research reports, icebreaker scripts, and other materials delivered by Estate Leads are for the personal professional use of the purchasing agent only. You may not resell, redistribute, sublicense, or share Estate Leads content with any third party without our express written consent. The Estate Leads name, logo, and website content are the intellectual property of Estate Leads and may not be reproduced without permission.

To the maximum extent permitted by applicable law, Estate Leads shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any lead package, including but not limited to lost profits, lost commissions, or reputational harm. Our total liability to you for any claim arising from the Service shall not exceed the total amount paid by you to Estate Leads in the 30 days preceding the claim.

These Terms of Service are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

We reserve the right to update these Terms of Service at any time. Material changes will be communicated by email to active subscribers. Continued use of the Service after any changes constitutes acceptance of the updated terms. Last updated: April 2026
